Name, Image and Likeness Information

Beginning July 1, 2021, student-athletes are permitted to earn compensation for their name, image or likeness. Below is helpful information for student athletes, supporters of Charleston Southern University Athletics and employees of Charleston Southern University relative to the South Carolina State Law and name, image, likeness.

The following provides a brief summary of the new interim policy to member schools, college athletes, and their families:

• Student-Athletes can engage in NIL activities that are consistent with the law of the state where the school they are enrolled is located. Athletes may also need to consult laws in the state where they reside. Colleges and universities may be a resource for state law questions.

• Student-Athletes can use a professional services provider for NIL activities.

• College athletes who attend a school in a state without an NIL law can engage in NIL activity without violating NCAA rules related to name, image and likeness.

• State law and schools/conferences may impose reporting requirements.

• SC State Law on NIL was set to go into effect July 1, 2022, but contained a provision that allowed the state to implement the law when the NCAA implemented interim NIL provisions. This occurred on July 1, 2021. The SC State Law is new and now in effect, see the link below to review the SC law.

• Recruits who enter into a name, image or likeness contract must disclose the contract to the institution and its athletic department prior to enrollment or signing a financial aid agreement.

• Student-Athletes are prohibited from receiving pay-for-play and impermissible inducements.

Additional information for Charleston Southern University Student-Athletes:
• For the purpose of securing compensation for the use of his or her name, image, or likeness, student-athletes may obtain an athlete/agent marketing representative, who must be registered in accordance with South Carolina Law.
• Compensation refers to money, goods or services, whether provided at the time or any subsequent date.
• The use of Charleston Southern University's facilities, uniforms, or protected trademark or product for NIL activity is not permitted at this time.
• NIL activity may not take place during the intercollegiate athlete's participation in academic, athletic, or team-mandated activities.
• Compensation for NIL activity may not come directly from the institution or its employees.
• The student-athlete must meet all academic requirements of the NCAA, Big South Conference, and abide by institutional policies related to class absences.
• The student-athlete must disclose the terms of an NIL contract to the institution prior to signing the contract.
• An student-athlete may not earn compensation for the use of his/her name, image or likeness for the endorsement of tobacco, alcohol, illegal substances or activities, banned athletic substances, gambling, including, but not limited to sports betting per the NCAA South Carolina State Law.
• Additionally, a Charleston Southern University student-athlete may not earn compensation from the use of his/her name, image or likeness that conflicts with existing institutional sponsorship agreements or other contracts or institutional values as defined by the Charleston Southern University Student Handbook.

Charleston Southern University Institutional Information:
• Charleston Southern University Employees (including student employees) may not directly or indirectly create or facilitate NIL compensation opportunities.
• Charleston Southern University may not use or allow any boosters (including Buc Club donors) to directly or indirectly create or facilitate compensation opportunities as a recruiting inducement or pay-for-play. However, boosters may be involved in approved NIL activity as defined by the state.
